Welcome to Design.org! We're excited you're here and ready to use our site to collect and organize awesome design, interact with other designers and be inspired! We're so pumped for you to get started, we wish we could skip all of this "legal ease" and send you on your way, but our lawyers say "that would be inadvisable." So, to see how we protect your privacy and our rights (so we're all here for years to come), please read the terms and conditions below.

The following terms and conditions govern all use of the Design.org website (The "Website"), content, and services (the "Services"). The Website and all blog content upon posting are owned by Design.org LLC (Design.org). The Website and Services are offered for use subject to your acceptance (without modification) of all the terms and conditions ("Terms") contained herein and all other policies and procedures, including but not limited to Design.org's Privacy Policy and Copyright conditions, which are subject to change (The "Agreement").

We ask you to please read this Agreement carefully and completely before accessing or using the Website, and by accessing or using any part of the Website, your agree to be bound by the Terms of this Agreement. If you do not agree with all Terms described herein, you must not access the Website, its Content or Services. Youngsters should note, only individuals who are at least 13 years of age are permitted to access the Website. If you accept these terms on behalf of a company or other legal entity, you agree that you have the authority to bind that entity to the Terms.

Design.org reserves the right, at its sole discretion, to modify, discontinue or terminate the Website or Services or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the modification on this page. We will also update the "Last Updated Date" at the bottom of these Terms. By continuing to access or use the Website or Services after we have posted a modification on the Website or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site, Application and the Services.

Your Account, Responsibilities and a Few Words on Privacy,

By signing up for a Design.org Account, you, the "User", agree that you take sole responsibility for maintaining the security of your Account, any activities that occur under your Account and any related actions on the Website. If you believe your Account has been compromised or used without authorization, you are required to notify Design.org immediately. You agree that any content, images, or comments posted from your Account will abide by all Terms and will not be posted in an unlawful or misleading manner, including the intent to trade on the name or reputation of others. Design.org reserves the right to remove any content in breach of these Terms, without notice, when material is deemed inappropriate, unlawful or likely to cause Design.org liability. You agree to release Design.org from all liability related to acts, omissions or misrepresentation by you, including damages incurred as a result of said actions or omissions.

You agree that you are entirely responsible for any Content (images, comments, keywords, material, links) posted on the Website or made available through the Website, the content of that Content and any harm that may result due to sharing content through your account, whether it be text or graphics. By making this Content available, you represent and agree that the copying and use of Content will not infringe the proprietary rights (including, but not limited to: copyright, patent, trademark, or trade secret rights) or yourself or any third party, and that you have fully complied with any third-party licenses or expectations related to the Content. You also agree that the Content does not contain and will not install or attempt to install any viruses, worms, malware, Trojan horses or any other harmful or destructive content; that the content is not Spam, or randomly generated content, and does not contain unethical or unwanted commercial content designed to drive users to a third-party site to boost the search engine rankings of a third-party site, or other unlawful acts (such as phishing) or to mislead recipients as to the source of the material (such as spoofing).

You agree not to post content that could be interpreted as obscene (including nudity or language), libelous, defamatory, hateful, racially or ethically objectionable, and does not violate the privacy or publicity rights of any third party. You agree that your account will not be advertised on third-party sites via unwanted electronic messages, including but not limited to spam links on other news groups, email lists, other blogs and websites, an similar unsolicited promotion.

Design.org reserves the right to freeze, disable, ban or remove accounts and/or content when we deem an account or content breaks the Agreement of Terms, or for any reason, with or without cause or notice.

Without limiting any of those representations or warranties, Design.org has the sole discretion and right, though is not obligated to: (i) refuse or remove content that, in Design.org's reasonable opinion, violates any of the Terms or Policy or is in any way harmful, hateful, offensive or otherwise objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason. Design.org will not be held responsible for any compensation or refund associated with said removal.

Design.org content is provided "As is," without warranty of any kind, and does not guarantee that we have reviewed, nor are we able to review all Content posted to the Website (text or image), and therefore cannot be responsible for the subject matter of the Content, its use or effects. Design.org does not represent or imply that we endorse Content nor that we believe it to be accurate, useful or non-harmful.

As a visitor and user, you are responsible for taking precautions to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content. You recognize that the Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Design.org disclaims any responsibility for the content or intent of any third party sites represented at design.org. We have not reviewed and cannot review all content available through third-party sites linked to on Design.org and sites that link to Design.org. By linking to other sites, Design.org does not imply that it endorses any third-party sites, and we disclaim any responsibility for any harmful or destructive content on or harm from non-design.org sites.

On Copyright: You Know, That Thing Where You Respect Others' Work?

Design.org strives to respect the intellectual property rights of fellow designers and expects users and visitors to do the same. If you feel that content at or linked to by design.org infringes on your copyright, we encourage you to notify Design.org at copyright@design.org. Design.org will respond to copyright concerns as quickly as possible, including as required or appropriate, removing or disabling infringing material. If a user repeatedly violates copyright (of Design.org or others), Design.org reserves the right, at its discretion, to terminate the user's account or deny access to and use of the website. Design.org will not be obligated to provide any refund or compensation based on such termination.

On Ownership: i.e. If It's not Yours, It's Not Yours and It Might be Ours

The Website, Services and Content are protected by copyright, trademark, and other laws of the United States and foreign countries. Except as expressly provided in these Terms, Design.org exclusively owns all rights, titles and interest in and to the Website, Services and Content, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Application, Services or Site Content.

Content Licenses
Subject to your compliance with the Terms, Design.org grants you a limited, non-exclusive, non-transferable license, without the right to sublicense, to access, view, download and print any Website solely for your personal and non-commercial purposes. Subject to your compliance with the terms and conditions of these Terms, Design.org grants you a limited, non-exclusive, non-transferable license, without the right to sublicense, to access and view any Member Content solely for your personal and internal business purposes. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Websites, Services, or Content except as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Design.org, except for the licenses and rights expressly granted in these Terms.

Indemnification
You agree to indemnify and hold harmless Design.org, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys fees, arising out of your use of the Website, including but not limited to out of your violation this Agreement.

This Agreement constitutes the entire agreement between Design.org and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Design.org, or by the posting by Design.org of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the State of Arizona, U.S.A.
